How long does a foreclosure take in Texas?
I've found all the legal jargon crud but can someone break it down in simple terms and plain english that make sense? It's an FHA loan in Texas at 5.5% fixed rate 30 year mortgage if that makes any difference. The loan originated 6 years ago and the property value is equal to or slightly less (within 5 to 8k) than the balance on the note.
I want to know the following things about the foreclosure process in Texas:
What is the actual time line for the foreclosure?
Does the time line start from the date of your last payment?
How long do you actually have before you're forced out of the house?
Is there any way to stall off the mortgage company and make it take longer?
How about my escrow money - is there a way to get it out prior to all this happening?, more

He placed a lien on the home for money that was owed to him and she agreed to sign the lien and the attorney filed it. Now she is one week away from foreclosure and cant make the payments. He is the primary on the note, and she is the secondary. My question is: can he get the house back if it is about to be foreclosed on to protect the lien? We can get it current again, but we want possession of the home. Help! What can we do? FYI we live in Texas. ANY HELP AT ALL would be great!, more

Contract Law Question: Can creditor who verbally agreed to payment over time change to demand payment in full?
The creditor is a Condominium Association led by an aggressive President who fooled Co-Owners into believing they all needed an expensive new roof when only limited repairs were needed. When Co-Owners were misled into approving it, the President demanded payment in full but allowed one Co-Owner to pay over time. In this, the President / Condo Association became a creditor and had a verbal contract with the Co-Owner for time payments. Time payments were made and the President cashed the first 3 checks from the Co-Owner. Then realizing they needed money now, the President demanded payment in full from the Co-Owner and threatens to put a lien on the Co-Owner's condo and possibly force them into bankruptcy or foreclosure if payment in full is not made. The Co-Owner obliged by all terms of the verbal contract but when the President changed her mind on the payment terms, she rejected all subsequent installment checks.
There is first the case of Fraud by the President to fool Co-Owners into a vote for a roof they didn't need (and evidence that the President had a kick-back deal with the roofer to profit from awarding them the exclusive, insider's contract.) But that is not what this question asks. This question asks:
1. Is not the verbal contract to accept payments over time BINDING on the President / Condo Association by virtue of the President cashing (signifying ACCEPTANCE of terms) the first few installment checks?
2. By rejecting installment checks after the first few, does this constitute DEBT FORGIVENESS such that the Co-Owner does not owe that money anymore?
3. As this is in the state of Texas where Homestead laws apply, are there any special limitations which would declare the President's actions to file a lien on the Co-Owner's condo (their only residence) and threaten foreclosure as either illegal or unenforceable?
4. By virtue of the fact that this verbal contract for time payments came about as a result of the President's fraud giving rise to the Co-Owner's debt to the Condo Association, could the contract itself be declared VOID or VOIDABLE? And if so, does not the fraud have to be proven first before the verbal contract be declared void or voidable?
Note that there appears to be no default by the Co-Owner under the terms of the verbal contract which might justify the President / Condo Association accelerating payments to demand payment in full now. The deal the President made was a bad one and not to the Condo Association's benefit, but it is a verbal contract and may be binding.
Furthermore, there was no discussion of INTEREST to be paid by the Co-Owner for installment payments.
5. Does the President or Condo Asssociation have legal recourse to demand that interest be paid by the Co-Owner for allowing time payments not afforded to any other Co-Owner?

Can a Bank Foreclose on Deceased Mom's House?
Can bank foreclose on deceased moms house even though the mortgage payments have been kept current? The situation is my mother passed away and left no will so my sister and I are awaiting probate hearings to determine the distribution of her properties. The hearings are being held up due to my grandfather who passed away a year prior to my mother's death and his will still has not been probated and until that takes place neither can my mother's. She owned two real estate properties a house in Texas and a farm in Oklahoma. The farm is titled/deeded in her name but the house in Texas is in her name but with a $60,000 mortgage against it with the est. value of the house being approx. $140,000. The mortgage is up to date and has been paid on time since her passing yet the bank, Frost bank recently stated to me and my sister that if nobody came forward and assumed the responsibility and put the mortgage in their name then they would foreclose on the property and we would lose it. My sister won't assume it, and I don't have the credit to do it myself or I would. Can Frost force the sale of the house by threats of foreclosure even though the will is still in probate and even though the loan is still being paid on schedule?
Let me add that my sister and I hate each other and since I am currently living in the house I would not put it past her to try and force me out in any way possible in efforts to try and get cash as soon as she can. We both knew the wishes of my mother as to regards to how she wanted us to distribute her estate and my sister has ignored them and become greedy and very deceitful about all of it and I want to know if she is lying to me about all of this, she is the manager of the estate and hasn't been completely honest on other matters as of yet., more

Foreclosure During Construction?
A foreclosure in the State of Texas.
I am in the middle of construction and the builder has taken money and left me 70% complete and way over budget. There is 141K left to draw from the bank but it is not enough to complete the house. I can finish the house with 141k but there are three liens and the house wouldn't be up to par as far as finishes are concerned. I have had other bids from other buuilders to complete the house and they all fall into the 250-260k range. I have done my research and those numbers make sense. The bank is not willing to work with me and give me the additional 100k in order to finish.
